Healura provides technology to help caregivers support autistic children through predictive physiological monitoring.
These Terms of Use and your conduct make that possible.

PLEASE READ THESE TERMS OF USE CAREFULLY. These Terms constitute a legal contract between you ("User") and Healura ("Healura," "we," "us" or "our").

IMPORTANT: HEALURA IS NOT A MEDICAL DEVICE OR DIAGNOSTIC TOOL. DO NOT USE THESE SERVICES FOR EMERGENCY MEDICAL NEEDS. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD CALL YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY.

BY ACCESSING OR USING THE HEALURA WEBSITE, MOBILE APPLICATION, OR ANY RELATED SERVICES (COLLECTIVELY, THE "SERVICES"), YOU REPRESENT THAT: (1) YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS, (2) YOU ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH HEALURA, AND (3) YOU HAVE THE AUTHORITY TO ENTER INTO THESE TERMS.

IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICES.

1. Description of Services

1.1 What Healura Does

Through the Services, Healura provides a predictive monitoring system designed to help caregivers of autistic children recognize rising stress through analysis of physiological signals. The Services include:

  • Wearable sensor technology for tracking physiological signals
  • Mobile application for receiving advance notice and reviewing patterns
  • Resources and tools to help caregivers respond to early warning signs

1.2 What Healura Does NOT Do

IMPORTANT LIMITATIONS:

  • NOT A MEDICAL DEVICE: Healura is not a medical device and does not provide medical advice, diagnosis, or treatment
  • NOT A REPLACEMENT FOR PROFESSIONAL CARE: The Services are not intended to replace professional medical, psychological, or therapeutic care
  • NOT FOR EMERGENCY USE: The Services are not designed for emergency situations requiring immediate intervention
  • NOT A DIAGNOSTIC TOOL: Healura does not diagnose autism, medical conditions, or mental health conditions

1.3 No Healthcare Professional Relationship

Your use of Healura does not create any healthcare professional-patient relationship. Healura does not provide medical advice and should not be used as a substitute for consultation with qualified healthcare professionals. Always seek the advice of your physician or other qualified healthcare provider with questions about medical conditions.

2. User Responsibilities

2.1 Appropriate Use

You agree to use Healura only as intended: as a supportive tool to help recognize rising stress early. You understand that:

  • Healura provides predictions, not guarantees
  • Professional healthcare guidance remains essential
  • Emergency services should be contacted for immediate safety concerns
  • The technology has limitations and may not predict all stress episodes

2.2 Account Registration

To use certain features, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

2.3 Device and Equipment

You must provide compatible devices and maintain internet connectivity to use the Services. You are responsible for any fees associated with your internet connection or mobile data usage.

3. Privacy and Data

3.1 Personal Data

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.

3.2 Health-Related Information

The Services, including software, algorithms, designs, and content, are owned by Healura and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Services for their intended purpose.

You retain ownership of the data you provide to Healura. By using the Services, you grant Healura permission to use this data to provide and improve the Services, subject to our Privacy Policy.

5. Limitations and Disclaimers

5.1 Service Availability

Healura strives to provide reliable service but cannot guarantee uninterrupted availability. The Services may be temporarily unavailable due to maintenance, updates, or technical issues.

5.2 Accuracy Limitations

While Healura aims to provide accurate predictions, you acknowledge that:

  • No predictive system is 100% accurate
  • False positives and missed predictions may occur
  • The technology is continuously being improved but has inherent limitations

5.3 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, HEALURA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HEALURA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES. IN NO EVENT SHALL HEALURA'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

7. Prohibited Uses

You may not:

  • Use the Services for any unlawful purpose
  • Attempt to reverse engineer or hack the Services
  • Share your account credentials with others
  • Use the Services in a way that could harm others or interfere with the Services
  • Violate any applicable laws or regulations

8. Termination

Either party may terminate your access to the Services at any time. Upon termination, your right to use the Services ceases immediately. Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination.

9. Updates and Changes

Healura may update the Services and these Terms from time to time. We will notify you of material changes. Continued use of the Services after changes constitutes acceptance of the new Terms.

10. International Use

The Services are controlled and operated from Germany. If you access the Services from other locations, you are responsible for compliance with local laws. The Services may not be available or appropriate for use in all jurisdictions.

11. Governing Law and Jurisdiction

These Terms are governed by German law. Any disputes shall be resolved in the courts of Germany. If you are a consumer resident in the EU, you may also have rights under the law of your country of residence.

13. Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Healura regarding the Services.

These Terms of Use are available in English and German. In case of any discrepancy between versions, the German version shall prevail for users located in Germany.
